The Board have no copy of any "regulations"
of the kind referred to in the Governor's communication.
They may state, however, that in certain cases local
authorities have obtained by local Acts such powers as
seemed necessary to suit their own needs. As examples
of clauses requiring the consumption of smoke, the Board
may refer you to section 39 of the Blackburn Improvement,
Act, 1882, as amended by section 86 of the Blackburn
Corporation Act 1898, to section 37 of the Blackpool
Improvement Act 1899, to section 38 (G) of the West Ham
Corporation Act 1893, to section 23 (1) of the Public
Health (London) Act 1891, and to section 42 of the
Newcastle-upon-Tyne Improvement Act 1853 as amplified
by section 52 of the Newcastle-upon-Tyne Tramways and
Improvement Act 1899; while as regards an enactment
for local purposes directed against the emission of
black smoke in such quantity as to be a nuisance,
reference may be made to section 37 (2) (A) of the
Blackpool Improvement Act, 1899.
